PREVAILING WAGE INFORMATION

Prevailing Wage Request Forms

The electronic form can be sent through e-mail. You can also submit a form via fax (303)318-8930. Please read all instructions thoroughly before printing, filling out, and returning the form (and instructions). Adobe Reader is required for the faxed form (www.adobe.com).
 

Prevailing Wage Determinations

The relevant factors in determining a prevailing wage rate are:

  • the nature of the job offer,
  • area of intended employment,
  • job duties for workers who are similarly employed
The employer may refer to the USDOL website which provides policy guidance to the state workforce agencies when determining which of the four wage levels to assign.

One aspect of granting a visa requires determining if the wage the employer intends to pay the alien meets the prevailing wage for that occupation in the geographic area in which the alien will be employed.

Prevailing Wage Process

The process of establishing the prevailing wage is as follows:

  • The completed electronic or hard copy Prevailing Wage Request form is e-mailed or faxed (303-318-8930) to the Labor Certification Unit from employers or their agents/attorneys.
  • The information from the form is logged in and given to the prevailing wage specialist for processing.
  • A prevailing wage determination is made utilizing the Occupational Employment Statistics/Alien Labor Certification (OES/ALC) survey unless a collective bargaining agreement applies.
  • The wage determination and related information are entered on the bottom of the Prevailing Wage Request form and faxed/e-mailed back to the requesting employer or agent. Requests are handled within 7 working days.
